An attorney explains what President Kocharyan is accused of doing. I'll give you the TLDR because that's what you're here for:

"People were protesting the official election results on February 23rd, 2008. There was NO state of emergency. That day, Kocharyan Defense Minister (after consulting with Kocharyan) issues the infamous executive order 0038, which instructed Yuri Khacaturov (also being prosecuted) to form a task force involving the MILITARY. This is against the Constitutional order, because the military can not be used in politics unless there is a state of emergency. Kocharyan declares state of emergency only on March 1st, a week after he had already involved the military. According to law, presidents can not be prosecuted while they are a president. Presidents can be prosecuted only for illegal orders once their term is over, which is what's happening now."

HHK has a foundation called Armenian Youth Foundation. The universities were told to contribute certain amounts to it annually. The Pashinyan administration has prohibited state-run universities from giving "donations" to the foundation. As a result, Yerevan State University will save AMD 125mln/year.
